A NEW LOOK AT CONTRACTUAL RELATIONS FROM SYSTEMIC LAW
Abstract
The present article has as its theme the systemic law in contractual relations, delimiting the integration of systemic laws in line with legal laws for the practice of conciliation between the parties, seeking an effective solution to the conflict. Through this study, we seek to demonstrate the method of family constellation in the composition of agreements ruled by the minimum intervention of the State, allowing the necessary balance and the permanence of effective agreements, providing the interests and will of the parties. Furthermore, under the auspices of the Economic Freedom Act 13.874/2019, articles 421 and 421-A of the Civil Code permeate the peaceful resolution of conflicts without state interference. It is proposed, in this way, through the hypothetical deductive method, to analyze the benefits and applications of this alternative method, as a means of assisting in the resolution of conflicts in the judicial scope, acting in the cause of the problem in a favorable way to the demands of the parties, through a look regarding systemic laws.
