THE GRANTING OF UNILATERAL GUARD IN THE LIGHT OF THE PRINCIPLE IN THE BEST INTEREST OF CHILDREN AND ADOLESCENTS

Abstract

This article aims to study the granting of unilateral custody, based on the principle of the best interest of the child and adolescent, a constitutional principle also present in the Statute of the Child and Adolescent. For this, doctrinal aspects and Brazilian legislation were examined regarding the principle of the best interest of the child and adolescent, then an explanation was given about family power, within the scope of conceptualization, historical evolution, ownership, legal relationship, rights and duties and its forms of extension, suspension and loss. In addition to dealing with unilateral custody and the right to live together, research was carried out on unilateral custody decisions in the best interest of the child and adolescent. For its development, the bibliographical methodology was used, exposing the main doctrinal arguments and the Brazilian legislation. In view of this, it is concluded that the best interest of the child must be prioritized absolutely, as it is the vulnerability of the minor, who needs full protection of his rights, always aiming at his well-being.
