Abstract

The legal nature of the doctor-patient relationship is an object of discussion, as there is a divergence regarding the applicability or not of the Consumer Protection Code in lawsuits arising from the physician's personal civil liability, and it is at this point that the problem arises about this study. The main objective is to reach a common denominator in the face of the antagonism related to the application of the Consumer Defense Code or the Civil Code and the Code of Medical Ethics in these bonds, for that, the doctrinal and jurisprudential analysis proves to be indispensable to conclude the appropriate legal framework of lawsuits between doctor and patient, which for now is questionable. Thus, in view of the relevant question, the purpose of study and scientific analysis arises. As a result, the understanding is extracted that it is fully appropriate to deal with the nature of the relationship between doctor and patient, as a purely civil demand, moving away from the Consumer Defense Code, using the doctrinal concept and characterization of these institutes, which will be duly addressed in this article. For this, the hypothetical deductive method will be used.
