GENDER VIOLENCE AGAINST WOMEN AND THE TYPICAL ADEQUACY OF STEALTHING IN BRAZILIAN CRIMINAL LAW
Abstract
Stealthing is one of the new themes that has been arising in the scope of Brazilian criminal law. This occurs when one of the parties removes the condom during sexual intercourse without the victim's consent or even knowing about it, noticing only at the end of intercourse. However, in addition to being socially repudiated, this practice has generated controversy for a number of factors. The emergence of social movements had a direct impact on sexual freedom, the practice of these, became a form of human pleasure. Nonetheless, these intercourse require several stages of consent, including consent to the use of condoms as a form of protection for the victim, thus preventing unwanted pregnancy or the spread of sexually transmitted diseases (STDs). Therefore, this article objective to analyze the crime called Stealthing according to the aspects of gender violence and the violation of fundamental rights, which are guaranteed to all people. Although, so that such questions are developed in a clear and objective way, a broad bibliographic study will be carried out, covering the opinions of national and international authors, in order to cite the Stealthing crime according to the aforementioned perspectives. For that, the deductive hypothetical method will be used.
