BIOPIRACY AND TRADITIONAL CUSTOMS OF LOCAL COMMUNITIES

Abstract

The research has as its hardcore biopiracy and the traditional customs of local communities, pointing out as a reason for this delimitation the concern to produce scientific knowledge for the discussion of questions about the legal protection of access to biodiversity and the misappropriation of its elements - biopiracy. Biopiracy is a new topic, not yet regulated, without a specific definition. It seeks protection indirectly in scattered laws such as Law 9.605/98 which deals with Crimes against the Environment, specifically in Crimes against Fauna and Flora and in the Federal Constitution through the protection of biodiversity, as well as in the Convention on Biological Diversity. The proposed problem consists of analyzing the need to criminalize biopiracy. The question is to what extent criminal protection may represent an efficient legal mechanism for the protection of Brazilian biodiversity and whether the exploitation of local communities in the Brazilian biome constitutes the crime of biopiracy. As a result, it was found that the criminalization of biopiracy, as well as the adequacy of existing criminal types and sanctions, are important instruments in the fight against the illicit appropriation of biodiversity and associated traditional knowledge, since the incriminating criminal norm plays a role not only of control, but also to prevent the emergence of harmful conduct to relevant legal interests. As a methodology, the deductive was used and as methodological procedures the historical-legal research, the legal-interpretative and the legal-propositional research that sought to analyze, interpret and understand biopiracy and the traditional customs of local communities.
