THE DEVALUATION OF THE VICTIM'S WORD IN OFFENCES AGAINST SEXUAL DIGNITY
in the process of producing evidences
Abstract
This paper aims to discuss how the word of the victim of sexual crimes is treated in practice in the process of producing evidence, as well as to seek to propose a means of resolving the dispute that does not harm the fundamental rights of any of the parties involved. In this context, the following problem arises: Is it possible to acquit for lack of evidence when the only proof is the victim's word? As for the methodology, the delimitation of the theoretical problem occurred from the deductive method, having as a starting point the macro analytical conceptions, namely, condemnation, sexual dignity and the victim's word, about the impossibility of acquitting the defendant due to lack of evidence in crimes against sexual dignity. The bibliographic survey provided the theoretical and doctrinal bases from books and texts by reference authors, both national and foreign. While the bibliographic framework uses the authors' reasoning on a subject. The first source of the research is the bibliography that instructed the analysis of the constitutional and infraconstitutional legislation, as well as the doctrine that informs the dogmatic concepts. As results achieved, it was verified that the conviction of the accused will be possible when a well-structured psychological study is carried out, to verify the likelihood ratio of the facts.
