THE APPLICABILITY OF THE CONSUMER PROTECTION CODE IN BANKING CONTRACTS
the finalist theory mitigated in banking contracts for working capital
Abstract
The objective of the work was to analyze the applicability of the Consumer Protection Code, in Law No. 8,078, of September 11, 1990, to bank contracts for loans for working capital acquired by legal entities in view of their vulnerability. The issue involved dealt with the application of the Consumer Protection Code in consumer relations when legal entities take out a bank loan to promote their activity, that is, their business. The concepts of working capital, consumer, supplier, types of vulnerability, whether technological, scientific, legal, socioeconomic and informational, will be presented and discussed, in addition to the theories used to define the applicability of the CDC in the specific case. The methodology used comprised the analysis of articles, as well as the examination of concrete cases, in addition to documentary and exploratory research on the topic. And as a result, it was found that the Mitigated Finalist Theory is very important for analyzing consumer vulnerability in the specific case.
