THE SEARCH FOR A JUDICIAL SETTLEMENT
analyzing the indexes of the Justice in Numbers 2016-2023 report
Abstract
The National Judicial Policy for the Adequate Treatment of Conflicts of Interest, implemented by Resolution No. 125, of November 29, 2010, of the National Council of Justice (CNJ), represented an advance towards the realization of the right of access to justice, especially in dissemination of consensual ways of resolving conflicts. Measuring the results of the scope of innovations in this field can be collected through the indicators contained in the official report of the Judiciary, Justice in Numbers, published annually. Therefore, the main objective of this study is to analyze the statistical data made available in the Justice in Numbers report, between the years 2016 and 2023, referring to the agreements concluded, from the perspective of the effectiveness of the judicial policy for the adequate treatment of conflicts. The research problem aims to answer: what reading can be done about the panorama of judicial self-composition in the country, based on the official indexes of agreements approved in the judicial sphere from 2016 to 2023, made available by the CNJ, in the Justice in Numbers Report? As a technical procedure, the study uses bibliographic research and documentary analysis, examining the indicators contained in the Justice in Numbers Report, between the years 2016 and 2022. As an approach method, the hypothetical-deductive method was used, with the main hypothesis the perception of relatively low rates given the set of changes and innovations made. The hypothesis is confirmed in the conclusion, indicating that the potential of self-compositional practices, such as mediation and conciliation, is not being achieved due to different factors related to the jurisdictional environment.
