INJUNCTIVE RELIEF AND THE LEGAL PROTECTION OF ANIMALS
analysis of the Théo leading case and the liability for mistreatment
Abstract
This paper aims to analyze the application of injunctive relief in cases of animal mistreatment, focusing on the leading case of the dog Théo. The problematization revolves around identifying the necessary criteria for granting urgent relief, as established by the Code of Civil Procedure and relevant environmental legislation. The research hypothesis suggests that recognizing animals as subjects of rights justifies the urgency of judicial intervention to prevent irreparable harm and ensure animal welfare. The adopted research method is hypothetical-deductive, grounding the analysis in pertinent legislation and case law. Methodological procedures include a bibliographic review of relevant norms and an analysis of concrete cases that illustrate the application of urgent relief in similar contexts. The results achieved demonstrate that the effectiveness of injunctive relief is essential for animal protection, highlighting the responsibility of guardians and the need for adequate and humane legal treatment. The research concludes that judicial intervention in cases of mistreatment not only restores the dignity of animals but also reinforces the evolution of legislation toward the protection of sentient beings' rights
