THE LIMITS OF THE STIPULATIONS IN THE CONDOMINIUM AGREEMENT
analysis of Special Resource 1.819.075/RS (rental of property in building condominiums via Airbnb
Abstract
This article aims to verify whether it is lawful to stipulate condominium related to the prohibition of rental of condominium properties through digital platforms - Airbnb. Therefore, the Special Appeal 1.819.075/RS was taken as the object of analysis of judicial decision and, from this, the relevance of the arguments and theses used by the ministers in the preparation of their respective votes was raised. In this sense, it was concluded that the decision from the Superior Court of Justice hurts the fundamental right of property by giving priority to the collective interest in the condominium agreement, thus lacking a weighting between the two protected legal assets.
