Abstract
This scientific article addresses the issue of obstetric violence from a legal perspective, examining how this practice violates women's rights and human rights. The study highlights the lack of specific criminal legislation for this type of crime in Brazil and analyzes its legal implications at national and international levels. The research compares the legal responses of different countries in relation to obstetric violence and highlights the need for greater attention from the Brazilian legal system. Furthermore, it investigates the current scenario and possible future implications for the protection of women's rights in childbirth. Through a critical analysis, the article contributes to raising awareness about the importance of appropriate public policies and legislation to prevent and punish obstetric violence, aiming to guarantee a safe and respectful obstetric experience for all women.
