The Brazilian copyright law compared to the German copyright law

Abstract

In the year 2021, the German court decided, in favor of YouTube, not to apply the indemnity claimed by the music producer Frank Peterson who had his musical and audiovisual works shared on the platform without prior authorization from the copyright holder. The purpose of this article is to assess the compatibility of this decision with German copyright law, as well as current European and international law. In addition, the issue of communication to the public of the work will also be addressed from the perspective of Brazilian and European law.
