THE INTERNATIONAL HUMAN RIGHTS PROTECTION SYSTEMS AND THE PROTECTION OF THE HISTORICAL AND CULTURAL HERITAGE AS A GUARANTEE OF EFFECTIVE CITIZENSHIP
Abstract
This article proposes an analysis of human rights and the development of their protection at the international level, more specifically with regard to historical and cultural heritage. Thus, it is necessary to understand the mechanisms of protection of these rights so that there is no state violation. In addition, the safeguarding of these assets is increasingly important for the development of society and the preservation of how contemporaneity has reached the point where it is. It is also noteworthy that international mechanisms, such as the Inter-American Court of Human Rights, work as an extra layer of guarantee in the fulfillment of human rights, monitoring the Public Power. Therefore, the State must seek a model of protection for these assets that fits both constitutional and conventional precepts, thus favoring the realization of a Democratic State of Law.
