REFLECTIONS ON THE RATIONALE AND NECESSITY OF RACIAL QUOTAS IN PUBLIC TENDERS AND THE EFFECTIVENESS OF ITS REGULATORY RULES IN COMBATING RACIAL INEQUALITY
Abstract
The present work aims to address the topic of racial quotas in public contests, their foundation, necessity, as well as their effectiveness in combating racial inequality. The work was developed through five topics that deal with: the origin of racial division, a brief historical account of affirmative action and its conceptualization, the effects of structural racism and legal exposure on racial quotas and their effectiveness in civil service examinations, particularly in the Judiciary. For the development of the work, the hypothetical-deductive method was applied, using bibliographic material, legislative text, and STF’s jurisprudence. After the analysis, it is estimated that quotas not only play a role in guaranteeing the entry of black people into the labor market but also in mitigating the effects of structural racism existing in Brazilian society, however, it is necessary for The Government to be more effective in combating inequality, guaranteeing citizens all their rights to then make use of the job vacancies, as well as to create mechanisms that provide effective integration into the labor market, preventing them from suffering from further discrimination.
